Article 1 - Object

The name Paraglide-Shop.com, the Anemos company and Pierre-Alain Hayoz is shown in abbreviated form in the text below as PSAPAH.

The present terms and conditions are applicable to sales by PSAPAH of sports services, remote services and sports and leisure equipment linked to paragliding and to freeflight activities in general.

When you finalise an order on the www.paraglide-shop.com website, it gives rise to a valid contract between the client and PSAPAH. The following conditions and provisions relating to offers of products and services on the www.paraglide-shop.com website are then applied:

Article 2 - Prices

Our product prices are based on Swiss Francs (CHF) including taxes (VAT and other taxes applicable on the day the order is made), unless otherwise stated and do not include administrative and shipping costs.

If your order is shipped to a country other than Switzerland, you are considered as the product importer. Customs duties, local or state taxes and import charges may be applied. PSAPAH is not responsible for these duties and taxes. They must be paid by clients and are their full responsibility, both in terms of customs declarations and payments to the relevant authorities and bodies in your country. We recommend consulting local authorities about these aspects.

All orders, irrespective of the client's country, are payable in Swiss Francs (CHF). PSAPAH reserves the right to modify prices at any time, but products will be billed according to the price at the moment the order was confirmed, subject to availability.

The products remain the property of PSAPAH until full payment is made. Please note: when you take physical possession of your order, the risks of loss and damage to the products are transferred to you.

Contractual information is given in English and will be confirmed when you confirm your order at the latest.

PSAPAH reserves the right not to accept payment and not to confirm an order for any reason whatsoever, particularly due to problems of supply or other difficulties linked to the order.

PSAPAH reserves the right to cancel or to refuse any order from a client with a payment dispute arising from a previous order.

Article 4 - Order confirmation

An order made on the Paraglide-Shop.com implies acceptance of the present terms and conditions. When you confirm an order, it involves full acceptance of the present sales terms and conditions without exception or reservation.

All the data provided and the order confirmation are considered as proofs of the transaction.

You accept full awareness of this information.

Confirming your order constitutes the signature and acceptance of the transaction. A summary of your order and the present terms and conditions in PDF format will be sent with the e-mail confirmation of your order.

Article 5 - Payment

Confirming your order involves a commitment to pay the given price.

Article 6 – Returns, exchange, cancellation

In accordance with the Swiss provisions of the Consumption, the company PSAPAH reserves the right to refuse the return, the retraction and the cancellation of order for all the material sold on the shop on line.

Article 7- Availability

Information about availability of products is provided when you make your order. Since this information comes directly from our suppliers, errors or modifications may occasionally arise. Your order cannot be cancelled if an availability error has occurred.

Article 8 - Delivery

Products are shipped all over the world to the delivery address given when the order is made and in line with the time schedule shown on the page for each product.

If shipment is delayed, we will inform you of any changes to the original delivery schedule by e-mail.

When shipments are made by a transporter, PSAPAH cannot be held responsible for a delay in delivery solely due to the customer's absence or a lack of availability when different time slots have been proposed.

Postage costs are calculated according to the contract price for the country of delivery.

Postage is free for purchases equal to or over 1000 CHF.

Article 9 - Warranty

All our products are subject to a legal compliance warranty and are guaranteed against hidden defects.

Any complaints must be made by telephone or by post within 14 days of delivery.  

Products must be returned to us in the same condition as you received them and including all elements (accessories, packaging, instructions). Postage will be refunded in line with the billed rate and postage fees will be refunded on presentation of supporting documents. 

Article 9 - Responsibility

The products on sale comply with prevailing Swiss legislation. PSAPAH cannot be held responsible for failure to respect the legislation in the country to which shipment is made. The client must check with local authorities about importing or using the products or services they intend to order. 

PSAPAH cannot be held responsible for damage resulting from misuse of a purchased product. 

Lastly, PSAPAH cannot be held responsible for any inconvenience or damage arising from the use of the internet, particularly a breakdown in the network, an outside intrusion or the presence of computer viruses. 

Article 11 - Applicable law for legal disputes

The French language version of the present contract is applicable. The present terms and sales conditions are subject to Swiss law. In the event of litigation, only Swiss courts will be competent. The competent jurisdiction is in 1630 Bulle Switzerland.

Article 12 - Intellectual property

All elements on the Parapente-Shop.ch website are and remain the exclusive intellectual property of PSAPAH. No one is authorised to reproduce or use, even partially, any element on the website, including software, visual and sound elements.

Article 13 - Personal data

PSAPAH reserves the right to collect information and personal data concerning yourself. These data are required to process your order, as well as to improve the services and information we provide to our customers.  

Data may also be transmitted to companies contributing to customer relations, such as the those concerned with the administration, processing and payment of orders and services.  

This information and these data are also stored for security reasons, in order to respect the legal and regulatory obligations.

Article 14 - Shipment of equipment outside Switzerland

Equipment shipped outside Switzerland is exempt from Swiss VAT. Customs fees and VAT in the destination country are to be paid by the client.

Article 15 - Archiving and Proof

PSAPAH will archive purchase orders and invoices in a reliable and lasting medium, constituting a reliable copy. 

PSAPAH's I.T. records will be considered by all parties as a proof of the communications, orders, payments and transactions taking place between the parties.
